Please retain for future use. These Terms and Conditions will apply to all transactions on this website and your purchase of a product or services confirms acceptance of these Terms and Conditions. We may update our Terms and Conditions from time to time, please refer every time that you order.
DISCLAIMER ACCESSORY FITTING GUIDE
All our accessories are easy to install for anyone with average DIY skills and the correct tools. Installing our accessories may invalidate manufacturers guarantee and craft functionality etc., do not open hatches on open water, incorrect fitting may cause damage. H2o Kayaks (H2O KAYAKS LTD) will not be held liable for any problems or issues that arise from the fitting of accessories supplied by us.
DELIVERY
All items offered for sale on this website can be delivered to UK Mainland addresses including the Scottish Highlands and Islands, Orkney, Shetland, Isle of Man, Channel Islands and Northern Ireland. For a delivery quotation to all other areas not listed (e.g., exports) please contact our sales office by email sales@h2okayaks.com and we will be happy to advise.
All goods must be checked and signed for on delivery by you or your agent unless sent by post or if a prior arrangement has been made to leave the goods without a signature. When you sign for goods received in good condition this is an acceptance that no damage has occurred so, please check. No damaged products can be returned if you have signed to say goods were received in good condition. If you arrange for goods to be left without a signature H2o Kayaks cannot accept responsibility that the goods arrived in good condition and are secure at the delivery address. Delivery dates and timescales are not guaranteed and do not form part of a contract between us. We will endeavour to make every effort to deliver goods on time but delays occasionally occur due to unforeseen circumstances. H2o Kayaks shall not be liable for any delay or failure to deliver within an estimated timescale. H2o Kayaks will do everything possible to ensure that you receive your order in perfect condition. In the event of missing parts, damaged or incorrect items, you must notify us within 48 hours of receipt.
ORDER ACKNOWLEDGEMENTS
An email will be automatically sent when you place an order acknowledging your purchase and payment however this does not constitute an acceptance of your order. Formal contractual agreements will be entered into when goods are dispatched or delivered to you. We reserve the right to decline all or part of your order for any reason.
PRIVACY
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 2018).
We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. This may include passing your details to our vendors for them to send your order to you, and also passing your details to delivery companies so that they can deliver your parcel.
The type of information we will collect about you includes:

- phone number
- e-mail address
We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in accordance with our internal security policy and the law.
We may use technology to track the patterns of behaviour of visitors to our site. This can include using a "cookie" which would be stored on your browser. You can usually modify your browser to prevent this happening. The information collected in this way cannot be used to identify you. Cookies what are they?
Cookies are pieces of text code placed on your computer by our server. Nearly all, if not every, major website and shopping site will use cookies. This is done for several reasons.
This site uses these tiny pieces of code to track, for example, what you have put in your basket, and to process your order. These are essential to the operation of the website and to enable you to purchase goods from the store.
They do not harm your PC and do not contain data which can personally identify you and definitely do not include sensitive data such as your credit card number! They have been used for years.

Which cookies do you set?
Zenid is a session cookie used by our store to operate successfully.
Cookies set by google:
_utma: determines the unique visitor id, visit count and when you visited. Expires after 2 years.
_utmb: tracks the time you enter our site and how long you stay. This is a session cookie and expires at the end of the browser session.
_utmc: works with _utmb to determine the length of your visit to our website. Records the time you leave the site. Expires 30 minutes after end of session.
_utmz: tracks where you came from on the web, the search engine used to find the website, what links were clicked on, what keywords were used, and where you are (i.e., geographic location when you accessed the website. Expires after 6 months.
PAYMENT
We will take your payment by Visa, Mastercard, Delta, Switch, UK Maestro, Klarna or PayPal at the time we process your order. If, for whatever reason, we are not able to fulfil your order, we will contact you and a full refund will be given. H2o Kayaks will take all possible precautions to ensure that your order and payment details are secure. All goods remain the property of H2o Kayaks and will only pass to you on delivery of the product provided full payment has been received.
In order to offer you Klarna’s payment methods, we might in the checkout pass your personal data in the form of contact and order details to Klarna, in order for Klarna to assess whether you qualify for their payment methods and to tailor those payment methods for you. Your personal data transferred is processed in line with Klarna’s own privacy notice.
PRICES
All prices listed on this website are in UK pounds sterling including Value Added Tax at the prevailing rate. Delivery charges are not included unless stated otherwise. The total cost of your order will be set out in your shopping basket/cart before you submit your order. This will be the price of the products that you have ordered and any applicable delivery charges. Products, prices and special offers are all subject to availability and these may change before you submit your order. Specification of listed products are subject to change without notice. Errors may sometimes occur and we will advise you accordingly and ask if you wish to continue with your order. If a product becomes unavailable, we will endeavour to offer you a suitable alternative.
RETURNS/FAULTY GOODS
H2o Kayaks will only accept returns by prior arrangement and within 14 days. Notification must be made either by; phoning us on 01603 279161 7 am to 3 pm Monday to Friday, emailing us at sales@h2okayaks.com or writing to us at Frogs Hall Farm, Spa Lane, Aylsham, Norwich, Norfolk, NR11 6US. Returned products must be complete, unused, and with the original box and packing.
Boat and kayak returns are subject to a 15% return handling charge with delivery at cost to H2o Kayaks, returns within 14 days and at expense of customer.
GUARANTEE
We offer manufacturers guarantee on our boats/products.
This covers any manufacturers defects such as faulty hatches, silicone seals, broken pad eyelets, mechanical parts (pedal boat cranks, bushings hubs, steering rods etc.) and stretched or broken bungee cord. Should your product become faulty within a year of delivery, we will offer a prompt repair, or if a repair is not possible, we will arrange an exchange. In this instance transport costs either way is not covered by H2o Kayaks. The guarantee does not cover faults caused by accidents, neglect, misuse, or normal wear and tear. If you are not happy with your purchase, we offer a 14 day no quibble refund policy provided that the returned product is complete, unused, and with the original box, packing and any accessories and the cost of returning and delivery of the product is paid by the customer. This policy does not affect your legal rights.
Products used in commercial applications are only guaranteed for 6 months from date on invoice. All Contour (Baywood Enterprises) pedal boat guarantee claims are covered by the manufacturers. All claims should be made directly to http://www.bwmarineproducts.com/sportcompany.htm
You will need; the serial number, pictures of damaged/broken parts and the date of purchase to enable Baywood Enterprises to process your claim.
OTHER GENERAL CONDITIONS
H2o Kayaks will at all times endeavour to verify the accuracy of all and any information on this website, however we cannot be responsible for colour and specification changes. All sizes and weights are rounded up or down to nearest measurement. We reserve the right to change specification and design at any time. You may not create any link to this website without our prior written agreement. Any contract between H2o Kayaks resulting from a purchase on this website will be governed by the laws of England and will be subject to jurisdiction of an English court. All goods sold on this website are intended for private use. Any business use of our products will invalidate the guarantee cover unless the goods are knowingly sold to a business.
Canoeing and kayaking are assumed risk activities. H2o Kayaks, its employees, suppliers and sub-contractors cannot be held responsible for any loss, damage, injury or death however caused. It is the customer’s responsibility to ensure they have the sufficient knowledge, skills and equipment for the activity they have chosen to partake in. Ensure you are familiar with all the relevant safety practices and procedures for your equipment and for the location in which you are using it.
